Trump signed an Executive Order that will strengthen the enforcement&nbsp;of&nbsp;U.S. customs laws through comprehensive reform.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Order directs the Department\u00a0of\u00a0Homeland Security (DHS) and U.S. Customs and Border Protection (CBP)\u00a0to\u00a0strengthen several\u00a0requirements\u00a0for\u00a0importers\u00a0of\u00a0record\u00a0(IORs). Examples include:<\/li>\n\n\n\n<li>increasing bonding\u00a0requirements\u00a0and requiring IORs\u00a0to\u00a0maintain at all times a minimum level\u00a0of\u00a0tangible domestic assets, bonding, or both;<\/li>\n\n\n\n<li>subjecting\u00a0foreign\u00a0IORs\u00a0to\u00a0heightened\u00a0requirements\u00a0for formal entry;<\/li>\n\n\n\n<li>authorizing only U.S. IORs\u00a0to\u00a0file informal entry;<\/li>\n\n\n\n<li>imposing a \u201cgood standing\u201d\u00a0requirement\u00a0on all IORs; and\u00a0<\/li>\n\n\n\n<li>increasing vetting procedures for all individuals and entities that conduct activities directly related\u00a0to\u00a0the importation\u00a0of\u00a0goods.<\/li>\n\n\n\n<li>The Order directs DHS and CBP\u00a0to\u00a0establish various disclosure and certification\u00a0requirements\u00a0designed\u00a0to\u00a0combat duty evasion and noncompliance with supply chain rules.<\/li>\n\n\n\n<li>The Order directs DHS and CBP\u00a0to\u00a0increase enforcement\u00a0of\u00a0existing customs laws, including by establishing a 50% minimum penalty floor limiting CBP\u2019s discretion\u00a0to\u00a0reduce the assessed penalties on\u00a0importers\u00a0who violate our customs laws.\u00a0<\/li>\n\n\n\n<li>The Order directs DHS\u00a0to\u00a0enhance the seizure and disposal\u00a0of\u00a0non-compliant imports, including by reducing regulatory burdens\u00a0to\u00a0voluntary abandonment and authorizing third-party disposal.<\/li>\n\n\n\n<li>The Order directs DHS\u00a0to\u00a0enhance transparency in customs, including by publishing annual transparency reports.<\/li>\n\n\n\n<li>The Order directs DHS\u00a0to\u00a0propose legislation\u00a0to\u00a0strengthen customs enforcement.\u00a0\u00a0<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>PROMOTING ECONOMIC STRENGTH AND NATIONAL SECURITY BY COMBATTING CUSTOMS FRAUD:<\/strong>&nbsp;President Trump recognizes the critical role&nbsp;of&nbsp;customs enforcement&nbsp;to&nbsp;our national security and that action is needed&nbsp;to&nbsp;address longstanding issues with the existing regulatory environment.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Customs enforcement is essential\u00a0to\u00a0the national security and economy\u00a0of\u00a0the United States. For example, it prevents the importation\u00a0of\u00a0unlawful and dangerous goods, and it ensures that IORs are accountable for duties owed and comply with numerous federal laws, including laws governing forced labor and product safety.<\/li>\n\n\n\n<li>Customs reform is long overdue. Systemic inefficiencies, loopholes, insufficient enforcement mechanisms, and outdated processes have created opportunities for malign actors\u00a0to\u00a0evade federal law.<\/li>\n\n\n\n<li>The Order addresses these longstanding concerns through comprehensive reform focused on protecting national security, promoting lawful trade, ensuring the timely collection\u00a0of\u00a0duties, modernizing systems and processes, bolstering compliance mechanisms, and protecting Americans and the domestic economy.\u00a0<\/li>\n\n\n\n<li>The Order also brings U.S. customs policy and practice in line with many\u00a0of\u00a0our trading partners. For example, the current practice\u00a0of\u00a0most\u00a0foreign\u00a0countries is\u00a0to\u00a0either prohibit\u00a0foreign\u00a0entities or persons from serving as the IOR or generally require that\u00a0foreign\u00a0importers\u00a0partner with verified domestic parties. This practice promotes compliance and accountability while reducing barriers\u00a0to\u00a0enforcement.\u00a0\u00a0<\/li>\n\n\n\n<li>The reforms directed in the Order will not take effect immediately.
